Terms of Service
These Terms of Service apply to the use of the AGNCI platform and all associated services. By using AGNCI, you agree to these terms.

In case of any discrepancies between this translation and the Dutch version, the Dutch version shall prevail.
1. Definitions
"AGNCI" refers to the provider of the platform. "User" means any natural person or legal entity that uses the platform. "Platform" encompasses the website, application, and all associated services. "Agreement" means the agreement between AGNCI and the User.
2. Acceptance
By creating an account or using the platform, you agree to these terms. If you do not accept these terms, you may not use the platform. If you are using the platform on behalf of an organisation, you represent that you are authorised to accept these terms on behalf of that organisation.
3. Services
AGNCI provides an AI-powered recruitment platform that enables staffing agencies and employers to match candidates with vacancies. We endeavour to keep the platform available 24/7, but do not guarantee uninterrupted availability. Scheduled maintenance will be announced in advance where possible.
4. Account and Use
You are responsible for maintaining the confidentiality of your login credentials. Accounts may not be shared. You are liable for all activities that occur under your account. Please notify us immediately if you suspect any unauthorised use.
5. Payment
Subscription fees are invoiced monthly in advance based on the selected plan. Payment is processed via direct debit or credit card. In the event of non-payment, we reserve the right to suspend access to the platform. All prices are exclusive of VAT unless otherwise stated.
6. Acceptable Use
It is prohibited to use the platform for unlawful purposes, to distribute malicious software, to overload or reverse-engineer the platform, or to unlawfully collect data from other users. Violations may result in immediate termination of the Agreement.
7. Intellectual Property
All rights to the platform, including software, design, and content, are vested in AGNCI or its licensors. You are granted a limited, non-exclusive, and non-transferable licence to use the platform for the duration of the Agreement. Candidate and vacancy data remain the property of the User who submitted them.
8. Liability
AGNCI shall not be liable for indirect damages, consequential damages, loss of profits, or loss of data. Our total liability shall in all cases be limited to the amount paid by the User in the preceding three months. The matching results generated by our AI are advisory in nature and do not replace human assessment.
9. Termination
You may terminate the Agreement on a monthly basis through your account settings or by contacting support. We may terminate the Agreement in the event of non-payment, misuse of the platform, or breach of these terms. Upon termination, your data will be retained or deleted in accordance with our Privacy Policy.
10. Governing Law
These terms are governed exclusively by the laws of the Netherlands. Any disputes shall be submitted to the competent court in the Netherlands. If any provision of these terms is found to be void, the remaining provisions shall remain in full force and effect.
11. Amendments
We reserve the right to amend these terms. Changes will be announced at least 30 days prior to taking effect, via email or a notification within the platform. By continuing to use the platform after the announced effective date, you accept the amended terms.
